Further to the agreement reached last month in the High Court that the UK Patent relating to data extraction would be revoked, we can now report that the European Patent has also been withdrawn.
This follows the efforts by BASDA, working alongside BASDA Member, Future Route.
As recently reported, this process has been on-going for over a year, with the High Court Proceedings starting back in March. To remove the risk of further impact on BASDA members from this Patent it was important that we also worked to achieve the withdrawal of the European Patent as well as that registered in the UK.
This Patent related to a process, see extract below, which was reviewed and found to raise serious concerns for BASDA members. BASDA therefore consulted with, and took action with the support of its members to evidence why this Patent should be revoked.
“a database driver associated with a data extraction to access and extract data directly from the database” and where “the data extraction module is arranged to bypass the management application and access and run the database driver independently of the management application”.
This further development underlines the scope and value BASDA members gain from being able to work collectively in such situations.
